A 41-year-old North Carolina mother is accused of abusing her 5-year-old daughter, allegedly allowing a registered sex offender to live in her home and repeatedly care for the girl — including giving her baths — without supervision despite being warned by authorities of the danger he posed to the child.
Candice Angela Malone was arrested and charged with one count of felony childcare in a sex offender home and one count of misdemeanor child abuse, court documents show.
According to an arrest warrant from the Lenoir Police Department, Malone allowed a 46-year-old man, Dale Ray Turner, to "babysit and care for her 5-year-old daughter without supervision." She did so despite being "aware of [Turner's] sex offender status" since the beginning of the year and having previously been advised by the county department of social services "to not allow him around her children."
"Yet she continued to let him live in the home with her and care for the child," the warrant states.
The misdemeanor offense alleges that Malone created a "substantial risk of physical injury" to her daughter by permitting Turner "to take care of her child without her present," which directly resulted in the 5-year-old being the victim of sexual abuse. Turner is also accused of taking pictures of the girl while she was in the bathtub.
Malone was booked into the Caldwell County Detention Center on Aug. 21. She remained in custody on a $50,000 bond as of Wednesday afternoon, jail records show.
Turner was arrested earlier this month and charged with child abuse and failing to comply with sex offender registration and online identifier registration, records show. He was previously convicted in Delaware in 2010 of raping a victim under age 16 and again in 2013 in Pennsylvania of indecent assault and sex offense against a child.
He was being held on $55,000 bond as of Wednesday.
