A 33-year-old Florida man is accused of trying to kill an Uber Eats driver, allegedly shooting the victim in the buttocks and threatening to kill him because the driver tried to get his girlfriend's phone number.

Khuslen Saruultuya was taken into custody and charged with one count each of attempted felony murder and aggravated battery with a deadly weapon, court records show.

According to a probable cause affidavit, the driver first encountered Saruultuya's girlfriend at about 2:35 a.m. Monday while delivering food to the Pearl Dadeland Apartments in the 7400 block of North Kendall Drive in Miami. The woman met him outside the main lobby, and the two briefly spoke. The driver told deputies he "took a liking to her."

The driver continued working in the area before returning to the complex at about 3:25 a.m., hoping to see the woman again and "possibly obtain her phone number," but could not find her, the affidavit states.

As the driver was walking back to his vehicle, Saruultuya allegedly pulled up in a gray Chevrolet Corvette, got out and "gave the victim loud verbal commands to lie on the ground while pointing at him with what the victim described as a semi-automatic handgun."

The driver complied, but Saruultuya allegedly fired one round that "grazed the victim on his right buttock." Saruultuya then allegedly struck him in the back of the head with the butt of the handgun, causing a 2-inch open wound, deputies wrote.

The driver told deputies that Saruultuya then ordered him to stand and pointed the weapon at his head, saying, "I am going to kill you." The girlfriend pleaded with Saruultuya, yelling, "Babe, please stop!" according to the affidavit.

Saruultuya allegedly chased the driver around the Corvette while continuing to point the gun at him as the girlfriend tried to hold him back. The driver fled and drove himself to South Miami Hospital for treatment.

A Miami-Dade Sheriff's Office deputy responded to a report of gunfire at an apartment complex at 3:34 a.m. A witness allegedly told the deputy there had been an altercation in which a man pointed a gun at another man. The witness said the man with the gun left in a two-door sports car with a Florida license plate. Investigators traced the plate to a 2021 gray Chevrolet Corvette registered to Saruultuya, the affidavit states.

A South Miami police officer working an off-duty detail at the hospital separately notified authorities when the victim came into the emergency room.

The driver later identified Saruultuya as the assailant from a photo lineup, authorities said.

Deputies took Saruultuya into custody at his home without incident and transported him to the Turner Guilford Knight Correctional Center for booking. He was being held without bond as of Tuesday evening, records show.
