After a one week hiatus, the murder trial of Georgia attorney Claud ‘Tex’ McIver is back in session. McIver is facing allegations of intentionally killing his wife Diane McIver on Sept. 25, 2016. McIver claims it was nothing more than a tragic accident.
The defense claims that McIver was holding a gun while seated in the backseat of a car for protection as he rode with his wife and their friend in an unfamiliar neighborhood. McIver claims that he fell asleep, only to awake with a start, resulting in the weapon firing by accident, shooting Diane through her seat. Diane McIver was said to have stated it was an accident before she died of her injury.
Before the trial was put on hold for spring break, there was a contentious argument that took place outside the jury’s presence. This dealt with whether or not prosecutors could present evidence from an emergency room doctor that McIver talked down to him in a racial manner when doctors approached to notify McIver his wife was dead. Ultimately, the judge decided that this evidence could indeed be presented, but that the prosecution would not be permitted to draw too much attention to this.
