Man shot and killed his cousin during dinner after complaining about how hot the enchiladas were: Police

A man in New Mexico shot and killed his cousin because of a fight that started over how hot the enchiladas they were eating were, according to law enforcement.

Ervin Gutierrez, 22, has been charged with an open count of murder in the death of 25-year-old Nathaniel Cavazos, the Bernalillo County District Attorney's Office announced in a press release.

The defendant is being held in the Albuquerque Metropolitan Detention Center without bond.

On the night of Aug. 28, Gutierrez drove to the Copper Hills Apartments on Spanish Bit Street Northeast in Albuquerque, to eat dinner with his cousins, Cavazos and another individual. The apartment complex is in the eastern side of the city.

The men were drinking when they began to argue, authorities said. Gutierrez was apparently chastising Cavazos about the heat of the enchiladas they were eating, saying the chiles inside were too hot, according to local NBC affiliate KOB.

Though the other cousin suggested they take their dogs for a walk to cool off, the argument reportedly turned physical and the suspect and victim began to fight.

Cavazos tried to walk away from the fight, the Albuquerque Police Department said, but Gutierrez allegedly pulled out a gun and shot the victim several times.

Authorities responded, but Cavazos was pronounced dead at the scene.

Gutierrez turned himself in, police said.

The defendant was booked into jail on Aug. 29 and he will remain in custody ahead of his trial. It is unclear when he is next scheduled to appear in court.
