A man is accused of fatally shooting his girlfriend inside an Ohio home and then immediately calling her mother to tell her what he did.
Lindburgh Borden, 19, has been charged with reckless homicide in the death of 18-year-old Emirah Overstreet, as well as tampering with evidence, according to Hamilton County court records reviewed by Law&Crime. He is being held in jail on $200,000 bond.
On Tuesday at about 1 a.m., Borden and Overstreet, who were dating each other, were at a home on Beekman Street in the North Fairmount neighborhood in Cincinnati, Ohio, per local CBS affiliate WKRC. Multiple other people were either inside or just outside the home.
What happened next is apparently being contested. Borden's attorney has claimed that his client was watching a third person play with a gun, and when Borden tried to stop him, the slide on the gun went off, causing it to fire and hit Overstreet without him pulling the trigger.
"He immediately called the young lady's mother and said, 'I accidentally shot and killed your daughter,'" the attorney reportedly said, adding that Borden also told someone else to call 911.
Police, on the other hand, were dubious of the claim that Borden didn't pull the trigger of the gun. A detective with the Cincinnati Police Department said Borden and the other person were posing with the gun before Borden grabbed it and it fired.
"The firearm does not go off without pulling the trigger," the detective said, WKRC reported.
A friend of Overstreet's recalled the moments right after the shooting.
"They came out yelling, saying that they had accidentally shot [her] and 'I killed your friend; I killed your friend,'" this witness said, adding that she often stayed outside this residence as people were known to play with guns inside.
She suspected Borden thought the gun was unloaded.
Overstreet was on the ground in the home, and though local emergency workers tried to help her, she was pronounced dead.
Borden reportedly turned himself in after the shooting. It is unclear when he is next expected in court.
